Terms of sale and use

These terms cover buying Suisai from this website and using the app. They're written in plain English on purpose. If anything here is unclear, email support@suisai.design and ask.

Who makes and licenses Suisai

Suisai is developed and licensed by Suisai Design, the registered business name of Shawn Truesdell, a sole trader based in Queensland, Australia. A registered business name is not a separate legal entity, so Shawn Truesdell is the person responsible for Suisai Design.

In these terms, "I" and "me" refer to Shawn Truesdell, and "you" refers to the person using Suisai.

Purchases are processed through Paddle or the Mac App Store, as explained below.

Buying from this website

Purchases from this website are handled by Paddle.com, which acts as the merchant of record. Paddle takes the payment, handles sales tax and VAT wherever you are, and issues your receipt. Paddle's Buyer Terms apply to the payment itself, alongside these terms.

If you bought Suisai from the Mac App Store, Apple sold it to you, and Apple's terms cover that purchase instead.

Your license

Suisai is a one-time purchase, with no subscription or account required. Your license includes all features available in the version you purchase, together with updates released for that major version.

Future major versions may be offered as paid upgrades. Your license to use the version you've purchased does not expire simply because a newer major version becomes available.

For purchases made directly through this website, your personal license is activated using a license key. Mac App Store purchases are licensed and managed through Apple's purchase system and applicable terms.

For direct purchases, your license key and key file are displayed when checkout completes and are sent to the email address provided during purchase. If you lose them, email support@suisai.design from that address and I'll re-issue them.

Your license key is personal to you, so please don't share it or post it anywhere. It carries your name, and Suisai shows that name in its About window.

Suisai checks your key on your own Mac. It never contacts a server to activate it or check it.

Refunds and revoked licenses

For purchases made directly through this website, you can request a full refund within 30 days of purchase, with no reason required. The process is explained in the refund policy.

Mac App Store refund requests are handled by Apple under its applicable policies and consumer-law obligations.

If a direct purchase is refunded, charged back, or confirmed to be fraudulent, its license may be revoked. Because Suisai validates license keys locally, revocation takes effect when the application receives updated revocation information, rather than through an online license check.

What you can't do

Please don't share or sell your license key, redistribute Suisai, or modify it to get around its licensing. The palettes and exports you make with Suisai are yours to use however you like.

Your rights under the law

Suisai comes with guarantees that cannot be excluded under the Australian Consumer Law. You may also have rights under the consumer protection laws where you live. Nothing in these terms excludes, restricts, or modifies those rights where doing so would be unlawful.

Except for rights and remedies that cannot legally be excluded, Suisai is provided as is, without additional warranties.

To the extent permitted by law, my liability arising from your purchase or use of Suisai is limited to supplying the software again, providing an equivalent replacement, or refunding the amount you paid for it.

Where section 64A of the Australian Consumer Law applies, my liability for a failure to comply with an applicable consumer guarantee is limited to the remedies permitted by that section, to the extent that relying on such a limitation is fair and reasonable.

These terms are governed by the laws of Queensland, Australia, subject to any mandatory consumer protections that apply where you live.

Changes to these terms

Changes to these terms will be published on this page with an updated date. Changes won't retrospectively remove rights already granted to customers, except where required by applicable law.
